Martin Kpebu Threatens Contempt Suit Against WAEC Over Withheld Results

Renowned legal practitioner Martin Kpebu has vowed to launch a contempt lawsuit against the West African Examinations Council (WAEC) over its decision to withhold examination results.

In an interview with Channel 1 News on Wednesday, February 5, 2025, Martin criticized WAEC’s lack of transparency in justifying its actions, specifically pointing out that the council denies candidates access to their results and fails to provide concrete evidence of misconduct.

According to him, the council’s reasoning for withholding the results is inconsistent, citing test misconduct one time and examination irregularities the next, which to him is a constant change of argument without concrete evidence to specify the exact offenses committed by the candidates.

“WAEC should be able to know exactly what each candidate was involved in, but it has not been able to do that, and yet WAEC is still holding on to the results. In that vein, we would say that WAEC is acting unreasonably,” he said.

Although the council has not followed the advice to publish their results, this stalemate also follows a past court decision that was in favor of the impacted students. According to Kpebu, this disobedience blatantly disrespects the rule of law and invades the rights of the engaged students.

In view of this, he emphasized that legal action in the form of a contempt lawsuit will be sought if WAEC keeps hiding the results without a clear reason.
